1.1. For COOK UP, the protection of Personal Data is a topic of the most importance. The Processing of Data, including Personal Data, is part of its activities and, accordingly, compliance with Data protection laws and regulations is one of COOK UP’s main priorities.
1.2. This Privacy Notice aims at informing the different Data Subjects on the purposes, nature and scope of the various Processing activities it carries out as a Data Controller when a Data Subject uses its Products and Services.
1.3. This Privacy Notice may be supplemented by additional privacy information provided to you in the context of specific Products and Services.

2.2. Personal Data related to Cardholders is collected through the execution of payment transactions in the context of the Products and Services provided by COOK UP.

4.1. Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

5.2. Please note that although we will act quickly, you may continue to receive mailings which are already on their way to you for a period of up to thirty days while your request is being dealt with.

6.5. What is the legal ground to process your personal data? We will only connect your cookies to your personal data if you are logged in to your COOK UP Account. If you are logged in to your account the legal ground is based on our legitimate interest.
6.6. How long do we save your data?
COOK UP does not save your personal data. You can easily erase cookies from your computer or mobile device using your browser. For instructions on how to handle and delete cookies please look under “Help” in your browser. You can choose to disable cookies, or to receive a notification each time a new cookie is sent to your computer or mobile device. Please note that if you choose to disable cookies, you will not be able to take advantage of all our features.

7.1. On the website of COOK UP, users are given the opportunity to subscribe to our enterprise’s newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.
7.2. COOK UP informs its customers and business partners regularly by means of a newsletter about enterprise offers. The enterprise’s newsletter may only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter shipping. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. This confirmation e-mail is used to prove whether the owner of the e-mail address as the data subject is authorized to receive the newsletter.
7.3. During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a data subject at a later date, and it therefore serves the aim of the legal protection of the controller.
The personal data collected as part of a registration for the newsletter will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by e-mail, as long as this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data, which the data subject has given for sending out the newsletter, may be revoked at any time. For the purpose of revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller, or to communicate this to COOK UP in a different way.

9.2. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
We may disclose your personal information to third parties:
- In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
- If COOK UP is acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
11.1. As part of our efforts to make further improvements to the service we provide to our customers, telephone calls to and from us may be recorded or monitored and used for training purposes. To protect the operation of our computer systems we monitor incoming and outgoing email.
12.1. COOK UP will share Personal Data with its affiliates, financial institutions, Payment Schemes, fraud prevention entities and other entities that process payment transactions with the purpose of delivering the Products and Services. For example, during the processing of payment transactions, COOK UP will transfer data to third parties, such as the acquirer, the cardholder’s issuing bank and the card’s scheme in order for the transaction to be completed.
12.2. COOK UP will share the cardholder and transaction information with the acquirer and its service providers which is necessary for providing information on the executed transaction (e.g. response code of the authorization, information to be able to complete refund), detecting and preventing fraud and proving compliance with its contractual obligations.
12.3. COOK UP will disclose Personal Data to public authorities, government agencies and judicial authorities if it is required to do so by law or legal process, when it believes disclosure is necessary to prevent harm or financial loss, in connection with an investigation of suspected or actual fraudulent or illegal activity, or when it is required for COOK UP to defend itself against legal claims.
12.4. COOK UP will not sell or otherwise disclose personal information it collects about you, save for the purposes described in chapters 2 and 3 above, except if so stated at the time the Personal Data is collected.
COOK UP will retain the Personal Data for as long as necessary to deliver the Products and Services requested during and after the end of its contractual relationship with the Merchant, according to the industry standards (for example, transaction information is retained for as long as required according to the applicable standards and regulations), according to the applicable Legislation (for example, retention periods defined by antimoney laundering legislation, tax law etc.) and according to its legitimate business interest, unless prohibited by law, in accordance to this Privacy Notice (for example, COOK UP may continue contacting you for a period after the end of the Contract, unless you decide to optout from such communication).
